勞動合同簽訂能提升農民工的工資嗎?[1]

摘要:本文基于2016年流動人口動態監測調查數據,在調整了勞動合同簽訂對工作時間的影響所帶來的度量偏差的基礎上,應用內生處理回歸模型消除了勞動合同選擇的內生性,分析了勞動合同簽訂對農民工工資的影響。研究結果表明,在國有部門,簽訂勞動合同能夠使得農民工工資得到顯著提升;在私營企業,由于簽訂勞動合同會為企業帶來較高的成本,企業愿意為未簽訂勞動合同的農民工提供工資補償,簽訂勞動合同的農民工工資水平較低。盡管在私營企業勞動合同簽訂并未使得農民工工資得到提升,但《中華人民共和國勞動合同法》(以下簡稱《勞動合同法》)的約束提升了簽訂勞動合同農民工的就業保障水平,間接提升了未簽訂勞動合同農民工的工資。因而,在現階段通過《勞動合同法》約束用人單位與農民工簽訂勞動合同是必要的。政府部門在法律約束勞資雙方簽訂勞動合同的基礎上,提升農民工群體在勞動合同簽訂中的談判能力,增強其維權意識,能使得勞動合同簽訂為農民工群體帶來更多的利益。

Can Labor Contract Raise the Wages of Migrant Workers?

Abstract:Based on the 2016 Dynamic Monitoring Survey Data of National Migrant Population,this paper analyzes the impact of labor contract on wages of migrant workers using the endogenous treatment regression model.The research results show that in the state sector,labor contract can help to increase migrant workers' wages significantly;in private enterprise,as signing labor contract bring higher costs for enterprises,enterprises are willing to provide wage compensation to migrant workers who did not sign labor contract,thus there have the low level wages for migrant workers who sign labor contracts.In spite of the private enterprise labor contract do not make migrant workers' wages promoted,The Labor Contract Law still increases the security of the migrant workers who sign labor contract,and increases the wages of migrant workers not sign labor contract.Therefore,it is necessary to constrain employer sign labor contract with migrant workers through The Labor Contract Law at the present stage in China.On the basis of constraining employer sign labor contract with migrant workers under the law,the Government departments should improve the negotiations skills of migrant workers in signing labor contract,and enhance their consciousness to maintain their rights.These measures can help labor contract signing bring more benefit for migrant workers.
